Thinking about promotion

I was thinking of starting something called the MySpace Referral Program (MSRP).

My first few games, I won't be submitting to GG for possible publishing.

In the MSRP, my studio will post a bulletin promoting a finished game. That person then re-posts that bulletin to others creating a branch effect. If someone buys a product, they type in the myspace link of the person who referred them. If that person gets x amount of referrals, they will win free stuff.

I have a question however. Let's say someone does get x amount of referrals, and would like Elder Scrolls 4 as their free choice. Is it legal to give purchased games away for free? I remember reading some EULA's stating "No Redistribution". Do they mean "no selling" or "don't give this to anybody but yourself"?

As long as you leave it *shrinkwrapped* you shouldn't have anything to worry about. You're just acting as a distributor.

No law against giving gifts I guess. Silly question really..

Well once it's opened, you are bound by the license. until then no one is.
