Question about modding RW

Hey all,
I did some digging for an answer, but gawd there's a lot of info on this site. I figure someone in the know could answer this easily enough with a yes or no. And the question is:
I keep seeing a lot of encouragement to mod Realm Wars as a way of learning about Torque. If I should do this to the point that my mod's using all new art assets - basically a total conversion - can I then package and sell the result as a whole new game? Or is RW its own property separate from Torque?

if you own a licence i guess you can rework it and then sell it through gg with credit to RW for the foundation
if you dont own a licence its still just a mod and as such you wouldnt be able to distribute it without them downloading RW and using yours as an appendage. you would definately not be able to sell it.

I will look into it but i think if you do a total conversion replasing ALL art and you are just talking cade you should be able to use it... I'm not sure though so i will check for you.

I guess what I was thinking is taking RW from its current unfinished state and branching it into a whole new project which, when finished, might bear very little resemblance to RW. Not so much a product where the end user would d/l the finished RW and then my add-on. But it would still likely contain RW code and scripting.

From what I understand (someone from RW/GG please correct me if I'm wrong), the code and script from RW are available to use in your own projects without limitation, provided you have a license. The art/maps/etc. still remain property of their owners, though, so you'd have to talk to them if you want to use or modify that.

The code and scripts in Realm Wars are considered part of the TGE source and are covered by the same license. The art, sound, etc is not. So if you replace all the art and sound what you have is simply a TGE project.

I would say you could use it for a RW mod or maybe even template art for your own project just as long as you give proper credit and are not using it for your own commercial project.
RW is being made by the community so pinning ownership to one person or group is hard if not totally wrong. Since it is community effort you could say ownership leis with the community or at least with all who contributed. This how ever doesn't mean that anyone from the community or who contributed a part can cannibalise it and use it how ever they want. It might sound a bit complicated but i believe with common sense and respect for the original creators you answer a lot of questions regarding this topic.

I think to the Realm Wars project should be a correct answer to that but also to the creator of the file. Much of the code, art & sound was created by GG staff (not the 'community') or at GG's behest, and released with Torque back in March '02 or thereabouts. ie. The ORC, crossbow, some sounds, the hovels, etc. prior to RW being given its own CVS and so on. Jeff Tunnell made a statement that yes, RW art could be used with Torque projects (no differention between commercial or non-commercial). It would seem to be more than passing difficult to lay claim to any of that prior work product as 'belonging to the Realm Wars community' as opposed to 'belonging to the Torque community', even if GG attempted a claw-back.

Unless someone signs over the exclusive rights to use it (something we should really clear up legally before people submit too much).
