I am just starting to learn the game engine and I am completely stuck. I use 3ds Max 9 and have no clue how to get my max files into the engine. I am using the demo version right now, is that part of the problem? Also I heard there is a plug in somewhere for max I have looked everywhere and can't find it... any and all suggestions/links/words of advice are welcome... Thanks

You can find help and documentation for the export process Here
If you meant you are using the demo version of TGE, then that isn't a problem. If you are using a demo of 3DSM, then I don't know if there are issues with using the plug-in (my uneducated guess is probably not).
What you are more or less looking at is modeling an object in Max. Certain rules must be followed: triangulate the mesh, create a proper node hierarchy, add a bounding box, etc. Once that is setup, you'll load the DTS utility to export the model and animation information into a format readable by Torque.
Static models are stored as .dts. Animations are stored in a .dsq. Once you have exported successfully, you have to load the objects up via script.
