Tge Eula And Afx Eula Vs Logo, Legalities

by Edward · in Torque Game Engine · 09/21/2007 (9:13 am) · 10 replies

Now my original question was could i use a animated logo in place of the 4 second screenshot logo.
For example
uk.youtube.com/watch?v=gKglGxyIrC8

I asked in the Garage Games IRC but the was no definite answer to my question. Now according to the TGE we have to and a qoute.
line 4b of the EULA
(b) Licensee agrees to display a full screen, unmodified Torque Game Engine logo for no less than four full seconds in the start up sequence of any game created and released with the Engine.

Now, apon purchasing AFX, there is no clause regarding the Logo, so im assuming that it defers to the TGE logo , however, the AFX kit itself does not use the unmodified TGE logo itself, which is in and of itself a Eula violation, if i read it correct. Now i need clarification. What consistitutes a Unmodified TGE logo, and if im using AFX does that mean i can just use the Round G logo instead of the unmodified torque logo. or is there some leeway to which GG, TGE , AFX logo i can use. It does show it during the TGE tutorial demo. But not the starter FPS or starter Racing. How much leeway do we have with it, and what is considered a unmodified TGE symbol.

Here is the AFX eula link

Here is the TGE eula link for 1.5.x (it is identical for 1.4.2 as well)

This is the unmodified TGE logo on the GG site

Here is the GG symbol included in the AFX kit and tge 1.5.2, no TGE engine picture during startup. it does show it during the TGE tutorial demo. But not the starter FPS or starter Racing.

Here is a example of the GG symbol released with the MMOKIT, note there is not a TGE symbol in the startup as well.

I believe you have to use the one on the site unless you gain special permission from GG. Just because a product, even a development product, uses a different logo, it does not mean that you can.

A very good question, though. It can cause confusion.

You mean i dont have to use a TGE logo, even if the product itself uses a different logo in 2 areas? it would seem like a pretty simple thing to just make it own products comply with its own EULA? In fact show me where the unmodified TGE logo is in the startup logos, for the products , if someone can point it out to me.

Keep in mind as well that the AFX kit operates under a commercial license, which removes the requirement to use any logo at all.

Umm Stephen, so your saying that if i am using AFX as my engine.. i do not have to even have a TGE logo or a GG logo?

No, that is not what I said. I said that the AFX developers have a Commercial license to develop with Torque, therefore they are not required to use Torque logos.

If you have an indy license of either/both, you are required to use approved Torque logos (see the logo kit link David provided above).

Ok, thank you for clarifying that up. which brings me to a silly question.. Why isnt said logo provided at least somewhere in the TGE kit? regardless if its free on the site. Maybe something to suggest at the next business meeting.

Ok looking through the Splashscreens provided, i can use any of the approved TGE/GG logos in that folder that applys to my product.. Just curious, who would i talk to about getting a animated logo approved, like the one i gave above?

Because it may change from time to time, and it's more convenient and timely for all to have it available in the latest form on site!

The time between purchasing a license and publishing a product is large enough that it makes more sense to have the logos available and downloaded when you near publication of your product.
