Ok so im thinking of buying some of the packs from garagegames, and im an indie. that said, if i buy the packs can i sell the game and not get in trouble or are the packs just to fool around with to get your feet wet? also im short and artist and money, so if anyone knows a LEGAL and perferably cheap way to get 3D models for elves, dwarfs, ect ect, please do tell. and by legal i mean i can use in the game and sell it without getting into trouble and losing my work.

You need to look at the license of the content packs you are purchasing. In general, they should grant you a license to use their art in any game you create. You can probably do anything with the art, so long as you don't resell it (either as a content "pack" or individual pieces). I would look at the license.

You could take a look at the models available at MMOWorkshop.com specifically the Avatar Pack www.mmoworkshop.com/trac/mom/wiki/StoreAvatarPack. The site notes:

Quote:These models can also be loaded into stock Torque with no modifications. However, they are not replacements for the default Torque biped player model. If you want to use them in stock Torque, you'll need to modify the C++ player source code.

Click on 'EULA' on the page for the content pack. Most seem to allow you to use of the content pack for one game, so I guess you would need to purchase it again if you use it in another game.
