Bounds remains the same size in game engine upon export

I am using 3ds max 8 and standard exporter. No matter what I do to the DTS or DSQ, the bounds remains the same size in the game demo. Is something in the game engine dictating the size of the bounds?

My character goes horizontal in the animation and the Bounds is not effected. What dictates the bounds? Is it the dsq?

I opened up my environment and loaded the same character. When I apply the death animation supplied with the demo, the bounds never changes in size, but moves in the x and y.

Another oddity, the bounds displayed isn't the bounds that I have created at all - L 3, W 3, H 3. I have opened the original player.max file supplied of the Orc. The bounds L 2.5, W 2.5 H 2.5 in that file isn't the same size of the bounds displayed in the game demo.

Something in the engine has to be dictating the length, width, height.
