Custom Animations Insanity

Hi !
I just purchased the AVA character pack for reference.
FYI I just found out against all laws of sanity;
1 .Open the source animation for example ava_forward.max
2. Export the animation
3. Works fine in-game.
Aaaand now comes the funny part:
1. Open the source animation ava_forward.max
2. Export the animation
3. Save the source ava_forward.max e.g overwrite it, just to keep things neat & tidy
4. No animations in-game.
What the f*ck just happened ?
BUT:
If you save the scene like ava_forward_XXXX (whatever you like).max it works again.
This happens with both 3dsmax 8 or 9.
So essentially I came into this conclusion that :
I can mod the animations as much as I like but after every minor adjustment to the animation
I'll have to save it with another name/in increments.
It's got to be something to do with the fact that the original source file was made with max 5.
But that doesn't make any sense either.
I'm not loving it (tm).

This happens also when you save the modified animation to ANY OTHER FOLDER than where
the ORIGINAL source was opened from.
