Hello fellow game developers and friends,
I have a simple question - in the United States, am I allowed to create an "R" rated game even if I am under 17, thats if the game ever gets rated by the ESRB of course?

My mom doesnt care, I know that - in Germany you are pretty much on your own with 15 the way we see it and even though we live in the US now, some things never change so I actually ment if I am allowed to by law!

Or if you use content which is already rated "R".
I'm sure its fine :-)... I'm not a yank myself though.
Just put your efforts towards your game :-), surely that is all that matters.

I don't think it really matters. As long as it doesn't pertain to something with adult content, I think you'll be ok. Otherwise, just ask parents permission like Caylo said.

It is not illegal to sell rated M games to someone under 17, nor is it illegal to for someone under 17 to play them. There have been some movements to make selling them illegal, but no one has put forth a law to make it illegal to play them.
So the answer is: yes it is completely legal.

Games aren't rated as "R", so I'm assuming that you mean Rated "M" (Mature).It is not illegal to sell rated M games to someone under 17, nor is it illegal to for someone under 17 to play them. There have been some movements to make selling them illegal, but no one has put forth a law to make it illegal to play them.
So the answer is: yes it is completely legal.

Ok thanks for the great feedback, I am pretty confused though and sorry for that "R", "M" error there Im still getting used to that moving to the US from germany so if it is legal to sell them to people under 17 and to play them under 17 why do people allways ask me for my ID and why do they even have this rating system?

Some people feel that there should be laws restricting their sale. Others think that existing laws cover it good enough (like porn laws, and contributing to the delinquency of a minor, etc). A few think there should be no limits on what is sold to whom.

These are voluntary ratings - They're designed to give parents a quick overview so they can determine if it's something they want their kids to play. Most stores follow the guidelines, and don't sell the "M" games to minors, either for moral reasons (or more likely) because they don't want to get in trouble with parents and with consumer watchdog groups.Some people feel that there should be laws restricting their sale. Actualy in some states it is illegal to sell M rated games to underage, but its the store that gets introuble, i beleave its a $1000 fine per purchase, atleast here in washington state if im not mistaken.

Thanks alot for the great feedback and something that I have observed living in the U.S., do you guys really think that porn hurts a kids mind more than action movies where parts are blowing off people? Little test here with the movie Alien vs. Predator (AVP), this movie was rated PG-13 in the U.S. and 18+ in Germany but then a movie like Eurotrip was rated 12+ in Germany and R in the U.S. so I really see it this way:Europeans like Sex and Americans like Killing! ;)
