Naming the

(Damn return key), Anyway the original title was supposed to be "Naming The Game". So I'm in the prototyping stages of a project and I'm looking for a name for the game.

This part isn't the problem I came up with a name that fits well and I like....buts it's taken. Actually it was a game on the PS2 a few years ago.

Now my game will most likely be freeware, so can I use the name?

Most likely not. It is probably not only trademarked for use in videogames, but heavily trademarked. I wouldn't wander down that path if I were you. Especially if it is the first thing to pop into someone's head and they think that your title is a clone/spin-off/etc.
