License Clarification - for John

Hi - question for John,

I'm not actually making "games" with Torque Engine, I'm making cartoons.

The EULA for TGE Commercial says this:

2. LICENSE GRANT.

Licensor grants Licensee a single seat to an individual, a limited non-exclusive license to use the Torque Game Engine (Engine) for the purposes of making executable electronic single or multi-user products ("Products").

(a) Licensee may publicly sell, distribute, release, publish, transmit and/or exploit any Products created hereunder.

Which is perfect, however the lighting pack is not quite so clear:

Licensee may download this Software through a web browser or copy it from Garagegames approved distributed media onto a single computer for use in the creation of Games. Except as may be permitted under a separate written authorization from Licensor, Licensee shall not use the Software for any other purpose.
---------------------------

also:

---------------------------
(d) Licensee may publish, release, distribute, sell and/or transmit any Games created with the use of the Software without the prior written consent of Licensor.

which is fine - apart from my "product" is not a game

This product is your John so I thought I'd ask you what your view is, I'm assuming/hoping that the EULA is just a generic one and that the lighting pack will fall under the TGE commercial license that allows you to do whatever you like with the software as shown first in this post.

Hi Timlon,

For anything other than games you need to purchase a Torque Lighting Kit commercial license. Though only the Torque engines have commercial product pages, almost all of the products have commercial versions.
