Music Legal Issue

I have found a song that I would love to be the background music for my game. How can I go about using it legally? Or would I have to get someone to make me a song that is close to it?

I have been a professional game programmer for over 5 years now. I've worked on virtually every platform, dozens of games and released a few of my own games, including 2 iPhone titles and a title waiting release on Big Fish Games.

Here's how it's done in the film industry. I believe the same process occurs for game development since you are synchornizing it to a video presentation. Pay special attention to part 4, which is where you look to find rights.

EDIT:
I've found that it's often good to pair with indie artists. They'll often give you a shout out on their site for their fans as well. Indie music + indie gaming + indie filmmaking = an exciting proposition for all!

Another possibility is to check out Opsound (and the Creative Commons in general). Even if you decide against using a particular CC licensed song, it's a good way to find musicians with a liberal view on licensing.
