EULA changed in 1.3?

Hi. I just noticed that the EULA you need to click "agree" to install in the 1.3 installer is completely different then the "indie" EULA on the website.
Doesn't this mean that anyone who installed 1.3 are on a completely different agreement now legally speaking? Is this a policy change on GarageGame's part? Would any employees care to comment?
