Is it legal to give out the Starter.racing and starter.fps 9as a mod sdk) if the Copyrights are intact or will i ahve to make my own.

As long as you don't give out the C++ source or claim it as your own work, you are probably fine.

Would it be better to write out my own mod sdk and claim the script i created for the sdk my own?

Can I regex "id Software" to "David Blake" in the Quake source and release it as my own commercial engine? Especially Tenebrae?

If you write out your own mod SDK (using the scripts and not the SDK, I'd assume), you should be fine. If you simply modify the GarageGames examples and claim them as your own, then there's something "wrong" with that. Credit should be given where it's due.

Maybe I just misunderstand.

Yes, the files thet have protions done by Garage games will have their copyright at the top, i'm no theif ;)
