From the EULA:
---
"Licensor grants Licensee a limited non-exclusive and non-transferable license to reproduce and use only for purposes of making source code and object code for electronic single or multi-player games ("Games"), the Torque Game Engine code version of the Software. This license does not entitle Licensee to receive from Licensor hard-copy documentation, technical support, telephone assistance, or enhancements or updates to the Software. Licensee may not redistribute, transfer, sublicense or sell the Software or exploit the Software in any other manner than as expressly allowed in this Agreement."

What about those situations where a team lead wants to buy a license for a member of his team? in essence would that not be a transferal of license?

If I recall correctly this subject was brought up in mid to late 2002 and was deemed OK. That is a team lead could buy TGE license for team members.

You cannot purchase company owned Torques. It is very clear in the EULA. Every person that uses Torque needs to own it. We do turn our heads some times to allow somebody to use a credit card that is not in their name to purchase the Torque, but the owner of the license is the person with the GG account name, not the card holder. In other words, you can have a company purchase your Torque, but YOU own it. You cannot leave the company and transfer ownership to another programmer.

I know this is kind of convoluted, but once you have the source code, it is hard to leave it behind. We feel this is a pretty good compromise to allow the price of our product to be as low as possible.

Jeff, unless they're ready to fork out 10k, in that case the company has 5 seats, right ? (commercial licensing of TGE for those who are not aware of that possibility ;))

Jeff,

I think my comment might have misconstrued. What I intended to convey is that it would be legal for me to purchase a TGE license for a friend by getting a desired username/password from him/her, registering and purchasing in his/her name.

I recall a dev team (might have been Bad Land Games) doing just that, one chap bought a license using the desired username/password of the intended TGE owner.

Ron,

Why not give your friend 100 bucks and have your friend buy it?

Either way once your friend owns a copy of torque they can't return it to you.
